Our Case Studies Nursing care mistakes at Castle Hill Hospital cause husband’s death. Mr B, who was aged 58, was admitted to Castle Hill Hospital as an emergency on 7.1.06, complaining of unsteadiness on his feet. No assessment of the risk of him falling whilst in hospital was performed. On 17.1.06, he was found on the floor of his room, having fallen. Later the same day, he suffered 2 further falls. Despite this, the nursing staff failed to assess the risk of further falls and take appropriate action to prevent this from occurring. On 23.1.06, he was again found on the floor, having fallen. Investigations revealed that he had sustained a fracture of the right hip; surgery to correct this was unsuccessful after he developed a chronic infection. The effect of this proved to be devastating; he became confined to a wheelchair, needed a permanent catheter, required regular IV antibiotics (which caused him to suffer with sickness) and was unable to enjoy his previous hobbies and activities. On 19.8.07, he died from liver failure. The chronic infection, caused by the Defendant’s negligence, accelerated his death by a number of months. After detailed investigations by Williamsons Solicitors, expert medical evidence identified negligent treatment in respect of the nursing care provided to Mr B and the damage attributable to this. A detailed Letter of Claim was sent to Hull and East Yorkshire Hospitals NHS Trust, but they did not respond to this. Court proceedings were therefore commenced promptly; this led to settlement negotiations. An out-of-court settlement of £40,000 was agreed, to represent Mr B’s pain and suffering and the losses suffered by both Mr and Mrs B. Initially, Mrs B went to see her local Citizens Advice Bureau and they told her that there was nothing she could do.
