Largest Clinical Negligence Settlement

After a 13 year struggle, the parents of Ben Harman were led to believe that their child’s brain injury was their own fault. After being seen by a specialist at a different hospital, they were told that an earlier error in his treatment was recorded in his medical records.

Ben had been discharged too early from hospital as an infant with low blood sugars (neonatal hypoglycaemia). He subsequently suffered a brain injury that left him with severe disabilities. Having instructed Lawyers, a request for the medical records was presented to the Hospital Trust involved, who initially argued that the parents had taken Ben home against hospital advice. Then, when the records were provided, it showed that the protocols had not followed which led to Ben’s brain injury.

Having tried their best to cover this up, it took the Hospital Trust 13 years to admit their failings, a letter of apology has finally been received and the case is expected to settled for over £20million, which will be the highest recorded payout.

Wayne Walker of our Clinical Negligence Department states “In a time that the Department of Health and the National Health Service Litigation Authority are blaming Claimants’ Solicitors for excessive costs, they fail to show that the cost of pursuing these claims is high due to complexities involved and the conduct of the Defendants or their representatives. No one likes to bring a claim against any medical practitioner but, in order to ensure accountability, and that those involved learn from those mistakes so that it does not happen to anyone else, an NHS complaint may fall on deaf ears, so a claim needs to be brought.

No matter what the value of the claim is, it is important to the individual to get answers and the peace of mind without having to wait an excessive amount of time”.
