Williamsons bring claim for “wrong site” surgery at Hull Royal Infirmary after never event declared

After a locum neurosurgical doctor performed surgery (L3-4 decompression) on his/her back, when the Consultant reviewed matters the following day it became clear that the operation had been performed at the wrong level.  It was therefore necessary to operate again at the correct position (L4-5).  The consequence of the delay and additional surgery are subject to ongoing investigations as part of an ongoing No Win, No Fee legal claim.

It is clear from the internal investigation conducted that this negligent surgical error should not have been made, one of the main reasons why this happened was inadequate communication between the surgeons involved.  When such an obvious mistake occurs, this is referred to as a “never event” because it should not happen.  Sometimes the result of a similar error or other “never events” can be catastrophic for the patient concerned.
