Former patients of Mr Rahul Jain, Consultant Orthopaedic surgeon have asked Williamsons Solicitors to investigate if the surgical care they received from him was negligent.
Mr Jain performed hip and knee replacement surgery at Clifton Park Hospital, York; Nuffield Hospital, York; The Yorkshire Clinic, York Hospital and Bridlington & District Hospital. However as at October 2018 we understand that he no longer works at Clifton Park Hospital or within Ramsay Health; the reason for this is not clear.
A client of Williamsons Solicitors, Mr Whitehead, underwent a hip resurfacing procedure at the Nuffield Health York Hospital, which was performed by Mr Jain under the NHS Waiting List Initiative. Following this Mr Whitehead developed pain and discomfort because of an increase in the length of his right leg; when measured, this was approximately 2.2cm longer than his left leg. It was eventually admitted that the surgery Mr Jain performed was negligent because avoidable errors had occurred. Unfortunately, Mr Whitehead had to take early retirement from his position as a PE Teacher. Nevertheless we were able to agree a £150,000 settlement on his behalf.
In April 2016, Mr Jain performed a full knee replacement on behalf of Brenda* at Clifton Park Hospital. Post-operatively, she developed pain and restricted movement. After no improvement with these symptoms a physiotherapist at the same hospital encouraged her to seek a second opinion. X-rays and examination revealed that her replacement knee prosthesis was very loose. She was advised that further surgery would be necessary to avoid serious complications developing; this is currently due to take place in the next few months. We are in the process of investigating whether the surgical treatment she received from Mr Jain was negligent.
Mr Nick Gray, Solicitor and Head of Clinical Negligence Department settled the claim for Mr Whitehead against Mr Jain and he comments: “Data from the National Joint Registry shows that Mr Jain completed at least 414 hip replacement and 288 knee replacements operations since April 2015. I’m concerned that the avoidable damage Mr Whitehead suffered might have also happened to a number of Mr Jain’s other patients”.
