Clinical Negligence, News

Simon Ramshaw is a solicitor with 30 years post qualification experience. He is an accredited member of the Law Society Clinical Negligence Panel and has been for a number of years.

In many of Simon’s cases rehabilitation is a key aspect of his work. Mr Ramshaw has secured interim payments in cases to ensure the earliest possible intervention in terms of psychological therapy to help clients reach their best possible outcome knowing that the sooner the appropriate treatment regime can be put into place the better the outcome is likely to be.

In the case of a man who suffered a leg amputation following admitted failings in hospital much of the important work was involved in securing interim payments, whilst the claim was still progressing, to have his client fitted with the most advanced prosthetics available in the UK so that he could return to the world of work as soon as possible. In many ways this was just as important for this client as the eventual damages settlement which ran into the millions of pounds.

Simon stays involved with the family long after the compensation claim has been settled using his experience to help manage awards and advise on the appropriate expertise needed by clients in later life as they meet challenges over time that they have not had to meet in the past. This can happen with medical accidents involving trauma at birth.

Proper planning and management of awards is essential to ensure that money is still available to help when it is really needed which can often be many years into the future as many of these cases do not come to light for the first few years of life and the next few years are usually spent dealing with the Defendant health authority who may be determined to deny liability, often until the last minute. Such cases can be concluded whilst the disabled child is still in their teens and whilst the family provide what care they can there is likely to come a time when the child’s parents are just not able to provide that continuing care as they would wish.

Mr Ramshaw is involved with projects to do with the setting up of care regimes, projects to adapt homes to meet the needs of any disability, obtaining specially adapted motor vehicles or other aids and appliances. The final award of compensation is very important, and he has secured literally millions of pounds of compensation following medical accidents for clients over the years, but it is the extra things which also help rebuild family’s lives.
