Anyone else confused?

You may have all seen on the news on the 9th April such headlines as “new divorce law ends conflict”  “no fault divorce”  well all correct but the timing of the announcement leads you to believe that these changes came into force on the 9th April, unfortunately that is not the case, however, it has been agreed that the divorce system shall be overhauled once the government has time to deal with it! Currently Brexit is taking up such time with the government.

We are moving to a new era in matrimonial law and the move to a “no fault divorce,” currently in order to issue a petition for divorce it has to be someone’s fault such as “adultery, behaviour, desertion” as well as 2 years separation with consent or waiting 5 years. The new changes will take away that provision.

The new changes will continue to embody “the irretrievable breakdown of marriage” but without the blame and the new procedure will take a minimum of 6months to allow time for the parties to change their minds.  Watch this space for more information, we shall provide an update when we know more.
