Are you entitled to claim for personal injury?

One in four adults has suffered a recent personal injury or accident, yet only 20% have made a claim, leaving millions of pounds of compensation unclaimed each year.

These figures come from Personal Injury 2012 – a YouGov survey conducted last year into the personal injury claims market.

The report highlights how road traffic accidents (RTAs) make up the majority of claims (around 50%), followed by accidents in a public space (shop premises, public highways etc.) at 21% and accidents in the workplace at 16%.

The report also highlighted mixed attitudes towards personal injury compensation claims in Britain. Many of those who completed the survey recognised that without the help of Solicitors acting on a no win no fee basis, insurers would try and avoid paying out for legitimate claims and make offers for far less than a claim is worth. There’s also an underlying perception that the number of claims are getting out of hand, which is not the case.

The main reason respondents gave for not pursuing a personal injury claim was that they deemed their injury ‘not bad enough’ to warrant a claim. The second biggest reason for not claiming was they didn’t believe in compensation. Where does that leave the person who is left paraplegic after a road traffic accident in which they were a passenger?
