Our medical negligence department has significant experience at pursuing claims for compensation in respect of avoidable amputations. Sarah Jackson and her team have recently settled a claim concerning negligent vascular care for a life changing, multi-million pound sum.
As a result of the negligent care, Ms X was required to undergo an avoidable above knee amputation of the right leg. It was also alleged that, due to failure to appropriately treat the other leg, Ms X would require left below knee amputation, meaning that she would become a bilateral amputee in the near future. When this happens, she will need hoisting and her care needs will significantly increase.
Over a period of approaching 7 years, complex evidence was obtained, firstly to establish liability and thereafter to establish the value of the claim. Sarah and her team were able to secure admissions from the Defendant Trust and after doing so, she obtained substantial interim payments from the Defendant whilst the claim was ongoing to allow Ms X to undergo extensive inpatient and community rehabilitation, move into adapted accommodation, put private care provision in place and purchase a definitive prosthetic leg.
Sarah worked with a multi-disciplinary team of therapists, including physiotherapists, occupational therapists and prosthetists, to support Ms X and to help her make significant improvements in respect of her independence and to get back on her legs, which was always her main priority.
We, as a team, are so proud and happy to have secured such a positive outcome for Ms X, after working closely with her and her family for so many years. Now that the claim has been settled, Ms X is able to move on with the next chapter of her life, which will involve purchasing her dream home, which will be adapted precisely for her needs. She also now has the peace of mind through knowing that she has funds available to ensure that she has the best quality of life possible for the remainder of her days, with it being agreed that she will receive yearly payments for the rest of her life.
