Record settlement of £14.6m after negligence at birth

16 April 2015

News

The High Court in London has ordered United Lincolnshire Hospitals NHS Trust to pay in excess of £14.6 million for birth injuries after failing to monitor a mother during labour which led to the child being born with cerebral palsy.

Had the Trust’s doctors monitored the CTG (Cardiotocography), they would have realised that the baby was in distress and an emergency caesarean section should have been performed at that point. If this had been done, it was likely that the child would have escaped any injury.

The child will now require help and assistance from others for the rest of his life and the compensation will help to pay for this and all other treatment and care.

Wayne Walker from our Clinical Negligence department, comments:

“These scenarios are very uncommon and most hospitals usually get the treatment right. However, when the treatment is inadequate, it leads to life changing events that could have been avoided.

The legal process can be very daunting in itself, but with specialist representation; the burden can be lifted so that individuals are able to continue caring for their loved ones with as little disruption as possible”.
