Recent commentary from a high-profile personal finance expert has suggested that setting up a Lasting Power of Attorney (LPA) is little more than “form filling” that people can easily do themselves.

However, Rachael Scott, a wills and probate solicitor from our private client team, is urging caution.

More than 50,000 LPA applications were rejected in 2023/24 due to errors, highlighting just how easy it is to get them wrong, and the potential consequences of doing so.

“There are strict technical requirements and legal implications that need to be carefully considered, and even small errors or unclear wording can lead to delays or rejection by the Office of the Public Guardian,” she says.
