NO WIN, NO FEE

What is a Spinal
Negligence claim?

The spine, as well as giving your body structure and support, protects the spinal cord. The spinal cord is a delicate bundle of nerves, connecting all parts of the body with the brain; through these nerves, messages are communicated between the brain and the rest of the body.

The spinal cord allows you to control movements, actions and reflexes and if the nerves in the spinal cord are damaged, the messages flowing to and from the brain can be interrupted. This in turn can cause injury of varying severity, depending on the extent and location of the injury.

    In what instances may a
    negligent spinal injury
    occur?

    Negligent spinal injury may occur if there is an avoidable injury or trauma to the spinal cord; for example, this can occur due to misdiagnosis or mismanagement of infection, disease, injuries caused in an accident. It can also be caused by surgical error. Such a spinal injury can have life changing consequences, including:

    • Loss of movement and sensation at the point below the spinal cord injury;
    • Loss or change in sexual function;
    • Loss of bladder and bowel control;
    • Pain

    Types of spinal
    negligence claims

    If you have suffered spinal injury, which you believe is due to receiving substandard care, you may be able to bring a claim for negligence. Examples of the types of claims able to be pursued are:

    1. Cauda equina syndrome (CES) claims concerning delay in diagnosis and mismanagement
    2. Errors during spinal surgery
    3. Missed fractures of the spine
