What is a personal injury claim?

A personal injury claim is a claim for compensation following an accident that has left you injured or unwell. Not every accident leads to a valid claim – for a claim to succeed, we generally need to show that someone else owed you a duty of care, that they failed to meet it, and that this failure directly caused your injury.

Duty of care simply means the legal responsibility one person or organisation has to take reasonable steps to keep others safe. Drivers owe this duty to other road users, employers owe it to their staff, and businesses owe it to anyone visiting their premises. If that duty was breached and you were harmed as a result, through no fault of your own, you may be able to bring a claim with the help of our expert personal injury solicitors, on a no win, no fee basis.

Types of Personal Injury Claims

A personal injury claim is a claim for compensation following an accident that wasn’t your fault, that has left you dealing with an injury. The three most common types we deal with are:

  • Road traffic accidents – covering drivers, motorcyclists, passengers, cyclists, e-scooters and pedestrians injured in a collision. We also represent accident victims injured on the road by uninjured or untraced drivers operating any vehicle, bike or e-scooter.
  • Accidents at work – where unsafe conditions, poor training, or faulty equipment have led to injury or illness.
  • Trips, slips, and accidents in public places – such as falls caused by uneven pavements, or incidents in shops, restaurants, or other public spaces.

We’re also experienced in handling a wider range of claims, including:

  • Serious and complex injury claims
  • Faulty products and/or services
  • Public transport accidents
  • Farm accidents

If any of this sounds like what happened to you, we’re here to talk it through. Our team can help you understand what went wrong and whether you’re able to make a claim.

Who can make a Personal Injury Claim?

Claims can be brought by the individual who has suffered the injury. It can however be the case that, whether due to the extent of the injuries suffered or due to pre-existing issues, the person does not have the mental capacity to pursue the claim themselves. In such circumstances, a loved one, known as a Litigation Friend, can act on behalf of the injured person. Also, if a child has been injured, a claim can be brought on their behalf by a Litigation Friend.

Sadly, accidents can result in death and in such circumstances, a claim can be pursued by the loved ones of the Deceased, both on behalf of the estate of the Deceased and on behalf of those dependent upon them.

Personal Injury FAQs

The first step is to get in touch with our personal injury solicitors for a free initial consultation, where we'll listen to what happened and assess whether you have grounds for a claim. If we take your case on, we'll gather the evidence needed to support it, including medical records, witness statements, and CCTV footage where available, before approaching the party responsible for your injury.

Yes. Our Personal Injury Solicitors work on a no win, no fee basis, so you don't have to worry about legal costs if your claim is unsuccessful.

We'll start by gathering the evidence needed to support your claim, typically including medical records, witness statements, and CCTV footage. We'll also consult independent medical experts to assess your injuries and how they may affect you in future. Once we've built your case, we'll approach the responsible party, whether that's an employer, a driver, or a business, and work to secure fair compensation, going to court only if it's needed to get you the right outcome.

Generally, you must start a personal injury claim within three years of the accident, or from the date you first became aware your injury was linked to it. There are exceptions: claims involving a child can be made at any time before they turn 18, after which the three-year limit applies up to their 21st birthday. Where someone lacks the mental capacity to claim themselves, there's no time limit until capacity is regained or a legal representative is appointed.

There's no single "average" amount, as it depends on the severity of your injury, its impact on your life, and any financial losses such as lost earnings, medical costs, or care needs. Some claims settle for a few thousand pounds, while more serious cases can reach six-figure settlements. We'll give you a clearer picture once we've reviewed the details of your case.

You may have a claim if you were injured or became unwell as a result of an accident that wasn't your fault, caused by someone else's negligence. This isn't always easy to assess yourself, which is why we offer a free initial consultation to listen to what happened and give you honest advice on whether you have grounds to proceed.

Personal injury claims can be complex, as you need to show both that someone else was at fault and that this directly caused your injury. Medical evidence and witness testimony usually play a key role. It's not something we'd recommend tackling alone, but with the right legal support, many cases that seem daunting at first can be built into a strong claim.

Not usually. Most personal injury claims are settled through negotiation, without ever reaching a courtroom. We'll always aim to resolve your claim as efficiently as possible, though if a fair settlement can't be agreed, we're fully prepared to take your case to court to secure the outcome you deserve.

Yes. This is known as "contributory negligence" — you can still make a claim, though your compensation may be reduced by a percentage that reflects your share of responsibility. For example, if you were found 25% at fault, your compensation would be reduced by 25%. We'll advise you from the outset on how this might apply to your situation.

We understand you don't want to go to court if it can be avoided. Wherever possible, we'll try to settle your case through negotiation with the other side's solicitor and their insurer, or through mediation. In some cases, we may also consider early neutral evaluation, where an independent legal expert gives their view on the likely outcome at trial. We'll talk you through the options available and always aim to get you the best result with the least stress.

Not necessarily. While we have offices in East Yorkshire, we support clients across the UK and can handle your claim by phone, email, or video call, wherever you're based.

This varies depending on the complexity of your case. Straightforward claims where liability is accepted early may settle within 12 to 18 months, while more complex cases, particularly those involving long-term injuries or disputed liability, can take several years. We'll always aim to progress your claim as quickly as possible, while securing the compensation you're entitled to.

A claims management company isn't a firm of solicitors. They typically collect your details and pass your case on to a solicitor, taking a cut of your compensation along the way. When you come to us directly, you're working with qualified solicitors from the outset, with no middleman, no unnecessary fees, and a team who'll handle your claim personally from start to finish.
