Easements

An easement is a right benefitting a piece of land that is enjoyed over another piece of land owned by someone else.

Common examples of easements include a right to use a private road or path on someone else’s land or to run services through it.  The most usual way of creating an easement is by entering into a deed, but in certain circumstances easements may arise in other circumstances such as long user.  Easements can be a complicated area of law and therefore it is recommended that if you are looking at either granting a third party a right over your land or taking a right from a third party over their land that you seek specialist legal advice to make sure that all the necessary legal formalities are complied with.
