Licence to Occupy
A licence to occupy premises is different to a lease in that it is not a legal interest in land; it is simply a personal right or permission to use the land for the purpose permitted by the licence.
Although a licence to occupy is a separate type of agreement to a lease, it can be very easy to inadvertently grant an occupier a lease rather than a licence to occupy, even if the agreement itself is labelled as a licence to occupy. It is therefore strongly recommended that any party seeking to grant a licence to occupy or to enter into one seeks legal advice before doing so.
